ELIGIBILITY: The Raffle Ticket Giveaway is open only to (i) residents of the Village of Pelham or Pelham Manor who are 21 years of age or older at the time of entry (“Participants”). This Giveaway is void where prohibited by law. This Giveaway is subject to all applicable federal, state, and local laws, and regulations.
SPONSOR: The Raffle Ticket Giveaway is sponsored by The Friends of the Town of Pelham Library (“Sponsor” or “The Friends”) 530 Colonial Avenue, Pelham, New York 10803.
AGREEMENT TO TERMS AND CONDITIONS: Participation in the Giveaway constitutes Participant’s full and unconditional agreement to and acceptance of these Terms and Conditions and decisions of the Sponsor are final and binding in all respects. This is the complete and entire agreement with respect to the Giveaway.
GIVEAWAY PERIOD: The Giveaway begins on July 1 and will continue until Sept 28 2024 (“Giveaway Period”). All comments on the Sponsor’s Facebook and Instagram posts must be made before Sept 1 2024. Comments made after Sept 1 2024 will not be eligible for entry.
ENTRY: Participants who are 21+ and residents of Pelham or Pelham Manor and email the friends email account with their name, email address, phone number, and physical address (friendsofpelhamlibrary@gmail.com) will automatically receive one (1) entry into a random drawing for two (2) 2025 Pelham Novel Night Tickets (collectively, the “Prize”). The raffle tickets are sold for $25 USD each and each ticket gives Participant an entry to win. Prize: two (2) tickets to Novel Night 2025. Winners must specify the dinner of their choice by emailing the Friends of the Pelham Library (friendsofpelhamlibrary@gmail.com) within 7 days of the announcement of the 2025 Novel Nigt dinners. Participants in the Novel Night 2025 event are expected to adhere to any covid policies detailed. The Giveaway winner will be announced on September 28 2024. Participants will only receive one (1) entry, multiple posts will not result in multiple entries. The Friends reserves the right to rescind the Prize and select another winner if the winner is under 21 years of age and/or does not live in the Village of Pelham or Pelham Manor. Sponsor reserves the right to request that Participant provide Sponsor with identification to verify the information provided by Participant. Prize must be claimed by the winner within 7 days of the date on which notice of having won was sent to Participant or it will be forfeited and Sponsor may, in Sponsor’s sole discretion, select another winner.
Notwithstanding anything in these terms and conditions, Sponsor reserves the right at any time in its absolute discretion to: (i) cancel or modify the Giveaway, or any part thereof and (iii) substitute, withdraw or cancel any Prize for whom a winner has not yet been determined without prior notice and without having to disclose any reason thereof and without any payment or compensation whatsoever. No cash or other substitutions are permitted.
WINNER SELECTION: The potential winner of the raffle tickets will be selected by The Friends on Saturday September 28 2024. The potential winner will be notified September 28 2024. After the Giveaway Period, the winner’s name and other details may be published by The Friends at www.pelhamnovelnight.com, Facebook, Instagram, and/or any other locations as determined in The Friends’ sole discretion.
PRIZES: Winner wins the following prize. Prize: Two (2) tickets to Novel Night 2025, with the winner's selection of which dinner they will attend. Participants in the Novel Night 2025 event are expected to adhere to any covid policy detailed. EXCEPT FOR WARRANTIES AND CONDITIONS IMPLIED BY LAW, WHICH CANNOT BE EXCLUDED, THE SPONSOR MAKES NO WARRANTY, REPRESENTATION, OR GUARANTY, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATING TO ANY PRIZE INCLUDING BUT NOT LIMITED TO ITS QUALITY OR SUITABILITY AND SPONSOR, HEREBY DISCLAIMS ANY RESPONSIBILITY OR LIABILITY RELATING THERETO. Delivery shall be in person, at a mutually agreed upon time and place within the Village of Pelham or Pelham Manor.
GENERAL CONDITIONS: By participating and/or accepting a Prize, where permitted by law, each Participant grants unconditionally to Sponsor (and agrees to further confirm that grant in writing upon Sponsor’s request) and those acting pursuant to the authority of Sponsor, the irrevocable right to print, publish, display, broadcast, and use, worldwide in any media, at any time(s), the winner’s name, and the name, portrait, picture, voice, likeness and biographical information of the individual who entered on behalf of the winner, as news, information and for advertising purposes without additional compensation or review. Sponsor reserves the right to cancel or modify the Giveaway if any attempt is made to cheat or engage in fraud, or any other factor beyond the Sponsor’s reasonable control impairs the integrity of the Giveaway, as determined by Sponsor in its sole discretion. The Sponsor reserves the right in its sole discretion to disqualify any Participant it finds to be tampering with the entry process or operation of the Giveaway. Sponsor reserves the right to contact any entrant in order to verify the information provided in the entry. Sponsor reserves the right to require verification from Giveaway participants. Sponsor’s failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of any other provision.
SPONSOR’S RIGHTS TO SUBMITTED ENTRIES: Submission of entry (including, but not limited to photos submitted by Participant) grants Sponsor the right in perpetuity to reproduce, publish, use and edit such entry, in any way, in any and all media, without limitation and without compensation to Participant. By participating in this Giveaway, Participant represents and warrants to Sponsor that its submission does not infringe on any third party intellectual property rights.
LIMITATION OF LIABILITY AND EXCLUSION OF DAMAGES: BY PARTICIPATION IN THE GIVEAWAY AND ALSO BY ACCEPTING A PRIZE, EXCEPT FOR LIABILITY UNDER STATUTE WHICH CANNOT BE EXCLUDED, EACH WINNER AGREES THAT SPONSOR WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY CLAIMS, LIABILITY, OR CAUSE OF ACTION FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING WITHOUT LIMITATION PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE DELIVERY, ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE. IN NO EVENT SHALL THE FRIENDS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. THE FRIENDS’ MAXIMUM LIABILITY FOR ANY AND ALL CLAIMS IN THE AGGREGATE, ARISING UNDER OR RELATED TO THESE TERMS AND CONDITIONS OR THE GIVEAWAY IS LIMITED TO 25.00 USD, WHICH IS THE VALUE OF THE RAFFLE TICKETS.
DISPUTES: Participant agrees that all matters relating to this Giveaway, including all disputes, will be governed by the laws of the State of New York without regard to its conflicts of laws provisions. Participant agrees to the personal jurisdiction by and venue in the state and federal courts in Westchester County, New York and waives any objection to such jurisdiction or venue. In the event of any controversy or dispute between Sponsor and Participant arising out of or in connection with the Giveaway, Sponsor and Participant must attempt, promptly and in good faith, to resolve any such dispute, prior to taking legal action, by direct communication either on a telephone conference call or in person meeting. If Sponsor and Participant are unable to resolve any such dispute within a reasonable time (not to exceed fourteen (14) days of date of first good faith attempt to resolve the dispute by in person or telephone conversation), then dispute must be submitted to mediation to a mutually agreed upon mediator. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law.
